Terms of Service

These Terms of Service (“Terms”) govern your use of portraits.babzstudios.com (the “Site”) and any portrait photography services provided by Babz Studios Inc. (“Babz Studios”, “I”, “me”). By using the Site or booking a session, you agree to these Terms.

1. Use of the Site

You agree to use the Site lawfully and not to:

Submit false or misleading information
Interfere with the Site’s operation
Use automated tools to scrape, crawl, or harvest content
Reproduce, modify, or distribute Site content without written permission

2. Inquiries and Bookings

Submitting an inquiry through the Site does not create a contract or guarantee availability. A booking is confirmed only after I provide a written quote, you accept it in writing (including by email), and any required deposit has been received.

3. Quotes and Pricing

All quotes are valid for the period specified in the quote (typically 30 days). Prices are in Canadian dollars (CAD) unless stated otherwise. Applicable taxes (GST) will be added.

4. Deposits, Payments, and Cancellations

A non-refundable retainer is typically required to secure a session date. Specific deposit and payment terms will be set out in your booking agreement.
Final payment is due as specified in your booking agreement, typically before delivery of final images.
Cancellation and rescheduling terms will be set out in your booking agreement. Cancellations made within 48 hours of a session may forfeit the full session fee.

5. Image Rights and Usage

Babz Studios retains copyright in all photographs created during a session.
Clients receive a personal-use license to share, print, and display the delivered images for non-commercial purposes.
Commercial use, resale, or unauthorized editing of images is not permitted without written agreement.
Babz Studios reserves the right to use delivered images for portfolio, website, marketing, and social media purposes unless otherwise agreed in writing.

6. Service Delivery

I aim to deliver final edited images within the timeframe specified in your booking agreement. Delivery timelines may be affected by factors outside my control (illness, equipment failure, etc.); in such cases, I will communicate any delays as soon as reasonably possible.

7. Limitation of Liability

To the maximum extent permitted by law, Babz Studios’s total liability for any claim arising out of or relating to the Site or services is limited to the amount paid by you for the specific service in question. Babz Studios is not liable for indirect, incidental, or consequential damages.

8. Privacy

Your use of the Site is also governed by my Privacy Policy.

9. SMS Communications

If you opt in to SMS messaging, your use of that service is subject to the SMS Terms and the Privacy Policy.

10. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts of Alberta.

11. Changes

I may update these Terms from time to time. The “Last updated” date reflects the most recent revision. Continued use of the Site after a revision constitutes acceptance of the updated Terms.
